These individuals have fled unimaginable violence and persecution in their homeland and are now legally under the protection of the UNHCR. However, they confront severe violations of their rights in their host country. Immediate action from the UNHCR is crucial to safeguard their rights and dignity.
Context and Violations
Sudanese refugees in Egypt, seeking safety and protection, are encountering numerous systemic barriers that threaten their well-being and legal status. Recent reports indicate the following serious violations:
1. Arbitrary Detention and Deportation:
Sudanese refugees, who are legally under the protection of UNHCR, are being randomly apprehended from the streets and various public places in Egypt, often without justification. This unlawful practice results in their immediate detention and the risk of deportation back to Sudan, a nation currently engulfed in violent conflict between the Rapid Support Forces and the Sudanese military. Such actions contravene Article 31 of the 1951 Refugee Convention, which protects refugees from penalties for their illegal entry or presence in a territory.
2. Inhumane Treatment in Detention:
Those detained endure horrific conditions that violate their human dignity. Detention facilities are often overcrowded and lack basic necessities, exposing these vulnerable individuals to severe physical and psychological harm. The UNHCR’s Guidelines on the Detention of Refugees clearly state that detention should be a last resort and conducted in humane conditions.
Many of these refugees originate from regions such as Khartoum, Darfur and El Fasher, areas witnessing some of the most atrocious human rights violations, including rampant sexual violence against women and horrific acts of violence against children. These individuals are seeking asylum in Egypt not only from the immediate threat of violence but also from the trauma of having witnessed such brutalities.
3. Isolation and Lack of Support:
A substantial number of these refugees lack the financial means to support themselves or contact their families, further isolating them and making them vulnerable to exploitation and abuse.
Call for Strong Action
In light of these egregious violations, we call upon the UNHCR to take the following urgent actions to protect these legally recognized refugees:

Demand the unconditional release of all Sudanese refugees currently held in detention centers in Egypt. They must be treated with dignity, in accordance with the principles of humanity outlined in the UNHCR’s Handbook on Procedures and Criteria for Determining Refugee Status.

Initiate an independent investigation into the treatment of Sudanese refugees, focusing on the conditions of detention and actions of local authorities. It is essential that accountability measures be established to ensure those responsible for these violations are held liable.
